Terms and Conditions

I want every design project to be a smooth, positive experience for my clients. These Terms & Conditions set out how I work, what you can expect from me, and what I ask in return. They help ensure clarity, fairness, and a shared understanding from the start of our collaboration. By confirming a booking with Enchanted Gardens Design, you’re agreeing to these terms — and I look forward to creating something special for your garden.

Nature of Service:

Enchanted Gardens Design is a specialist design-only consultancy. Our services are strictly limited to the provision of intellectual property, including 3D visualizations, horticultural specifications, and precision technical and planting plans (at scales of 1:20 to 1:50).


Exclusion of Physical Labor:
To maintain the highest standards of technical accuracy, our service is strictly non-physical. Enchanted Gardens Design does not engage in, manage, supervise, or assist with on-site manual labor, including but not limited to:

  • Site clearance or waste removal.

  • Soil preparation or remediation.

  • Placement, layout, or planting of stock.

 

Implementation & Division of Roles:
This clear division of roles ensures the Designer focuses exclusively on technical specifications. The physical interpretation and execution of the design is the sole responsibility of the Client or their appointed landscaping professionals. Technical plans serve as the definitive guide for third-party implementation; the Designer does not provide on-site "pot placement" or "setting out" services.

I operate as a specialist design consultant. My expertise lies in 3D visualization and complex horticultural specification (such as suggesting remediation of allelopathic soil conditions). Due to my business model as a design studio, I do not provide any on-site physical services other than observing the site and measuring up. This allows me to focus entirely on the precision and technical accuracy of your plans.

Project Requirements: To ensure the long-term health and aesthetic integrity of my designs, I specialise exclusively in 'Clean Slate' or Full Re-Design projects. I do not offer services for 'filling in' existing borders, planting around mature established shrubbery, or working within existing root zones. This allows for proper soil remediation and a cohesive design result.

My design process is optimised for comprehensive garden transformations. I do not accept commissions that require working within or around significant existing planting schemes or mature tree root systems. My design process for 2026 is exclusively aimed at full 'Blank Slate' transformations. I have found that working around existing planting or uncleared sites compromises the design's integrity and prevents proper soil remediation (especially crucial for your allelopathic conditions). As a design-only consultant, I do not take on projects that require site clearance or manual plant integration. If you decide to fully clear the site through a contractor, I would be happy to discuss a new design at that stage. Please note that clearance of trees and large shrubs entails the thorough removal of stumps and roots below the surface - it is not possible to plant new plants in rootbound soil. Design Assumptions: Designs are based on visual site observations and geological data. Where physical access to the soil is restricted (e.g., by paving, turf, or pre-sale agreements), the design assumes standard remediation will be carried out by the Client's contractor. The Designer is not responsible for sub-surface conditions that were not visible or disclosed at the time of the survey.

Soil Assessment: The Designer performs visual assessments only. For sites with restricted access (paving, lawns, or pre-sale restrictions), the Client is responsible for providing a Soil Report. This involves the Client (or their contractor) digging a 30cm trial hole and providing photographs of the soil layers and a basic hand-texture description. If a chemical or nutrient analysis is required, the Client must commission an independent laboratory test.

Client Site Obligations: The Client is solely responsible for ensuring the site is fully cleared of all unwanted vegetation, debris, and existing plants prior to the commencement of the design phase. Work will not begin on uncleared sites. I do not offer site clearance services; these must be contracted by the Client to third-party professionals.

1. Scope of Service (The "Intellectual Property Only" Clause)

Consultancy Status: All services are provided as high-level architectural and horticultural consultancy. The final product consists of intellectual property in the form of technical 2D and 3D plans. The Designer does not provide physical on-site labour, including but not limited to site clearance, soil preparation, or manual plant placement. 

2. Client Responsibility (The "Blank Canvas" Requirement)

Site Readiness: The Client is solely responsible for ensuring the site is a 'Blank Canvas' prior to the survey. All existing vegetation, trees, and root systems must be cleared by third-party contractors. I do not accept commissions for 'gap-filling' or integration into mature, uncleared beds.

3. Soil Condition Disclaimer (The "Allelopathy" Clause)

Biological Failure: I accept no responsibility for the failure of plants due to existing allelopathic soil conditions (e.g., toxicity from Chestnut, Rhododendron, or Laurel, inter alia) unless a full soil analysis was commissioned by the Client and provided before the design phase. Please see section on Professional Remediation Advice for Clients below.
 

Professional Remediation Advice for Clients
These are the actions the client or their contractor must undertake before my design can be successfully planted:


Total Excavation of Toxic Material: For Rhododendron and Cherry Laurel, simply felling the plant is insufficient. The client must excavate the root balls and, crucially, remove the toxic humus layer (the mat of acidic, decomposing leaf litter). This layer often contains concentrated toxins and can prevent any new growth for years if left in place.


Stump Inversion and Disposal: For larger stumps that cannot be easily hauled away, flipping them upside down and brushing off the soil can help prevent regrowth. All debris from these plants should be burnt or disposed of via household waste rather than composted, as the toxins and some pathogens can persist.


Aeration and Decompaction: Allelopathic trees like the Horse Chestnut often sit in highly compacted soil. The client should employ decompaction techniques (such as using an air-spade or manual forking) to improve airflow, which helps break down lingering toxins like esculin more quickly.


Soil "Washing" or Replacement: In severe cases of toxicity, the client may need to "wash" the soil by loosening it and mixing in sand to help leach out chemical residues, or in extreme scenarios, replace the top 15–30cm of soil entirely with fresh, uncontaminated topsoil.


Organic Buffering (Biochar and Mulch): Applying Biochar can help sequester remaining toxins while improving soil structure. The client should follow this with heavy mulching using clean, non-toxic organic matter to encourage beneficial microbes that naturally break down allelochemicals over time.


Neutralising Acidic Sites: Sites previously occupied by Rhododendron are often extremely acidic. Adding lime to the soil can help neutralize the pH and make the area more hospitable to a wider range of plants.

I will provide a 'Soil Remediation Specification' outlining the necessary steps to detoxify your soil from existing allelopathic species (e.g., Horse Chestnut, Laurel). Please note that the execution of these remedies, including all physical excavation and soil amendments, is the sole responsibility of the Client and must be completed prior to the delivery of the final planting plan.

4. Implementation

Planting Layout: Technical plans are provided at scales of 1:50 or greater to allow for direct implementation by the Client’s chosen contractor. As the Designer provides definitive setting-out plans, no on-site manual placement services are offered or included.  

Physical Labour: All physical implementation of the design—including plant layout and planting—is the responsibility of the Client or their appointed landscape contractor. I am strictly unable to assist with on-site physical work. Any request for on-site 'placement' will be declined as it falls outside my professional scope and insurance coverage.

5. Legal Safe-Guarding (CDM & Management)

Project Management & CDM: I do not provide 'Project Management' or 'Principal Designer' services as defined under CDM 2015 regulations. My professional involvement concludes upon the digital delivery of final design documents. 

 

6. Final Deliverables & Implementation: My service concludes with the delivery of the final technical design and scale planting plans. The physical interpretation and execution of these plans—including the sourcing, layout, and planting of stock—is the sole responsibility of the Client or their appointed landscaping contractor. I do not provide on-site supervision, project management, or 'Principal Designer' services under CDM 2015 regulations.

​Terms and Conditions

1. Payment Terms

  • All fees are payable according to the agreed payment schedule. Partial payments do not alter the delivery terms or entitle the client to delay agreed payments.

  • A 50% deposit is required to begin work.

  • The balance is due before delivery of the final design package.

  • Additional services (extra revisions, site visits, or sourcing advice) are billed at £90 per hour plus mileage.

  • Late payments may incur a 5% monthly interest charge.

  • Final design delivery is conditional on receipt of the full balance. No designs will be released until payment is made in full.

2. Timeframes & Delays

Estimated timeframes will be provided, but unforeseen delays (weather, site access, client feedback delays) may impact project timelines.* Please see Point 3 below regarding client feedback delays

3. Client Feedback Delays

1. Project Dormancy Clause (The "Ghosting" Clause)
To maintain project momentum and fairness to all clients, feedback or approvals must be received within five (5) business days of a request. If no communication is received within 14 consecutive days, the project will be deemed 'Dormant.' At this stage, the project will be removed from the active design queue and archived to accommodate other awaiting clients. 
2. Re-activation & Rescheduling Fee
To resume a Dormant project, a non-refundable Re-activation Fee of £250 will be required. Once paid, the project will be placed in the next available slot in my current workflow. Please note that re-engagement does not guarantee an immediate restart, and timelines will be adjusted based on my existing commitments to active clients.
3. Client Obligations Clause
The Client agrees to provide all necessary information, assistance, and decisions in a timely manner. The Designer shall not be liable for any delays in completing services arising from the Client's failure to provide prompt feedback or from extended periods of non-responsiveness.

4. Revisions & Feedback

I offer up to two rounds of revisions on design concepts, while the design is at the software stage. Once drawing of plans has commenced, additional revisions may be charged at the hourly rate.
Feedback is welcomed and forms part of the design process — I ask clients to communicate clearly and constructively. 

5. Site Conditions & Existing Planting

Designs are based on site conditions observed at the time of the survey. Changes in site conditions (e.g. plant removal, tree work, soil changes) may affect the final design. Any significant physical changes to the site made by the Client (e.g., tree removal, hardscaping) after the survey that require design adjustments will be billed as additional work at the Designer's standard hourly rate.

My design process is optimised for comprehensive garden transformations. I do not accept commissions that require working within or around significant existing planting schemes or mature tree root systems. My methodology requires full access to the soil profile to address conditions such as allelopathy and compaction, which is not possible when preserving existing specimens.

6. Liability & Implementation

I provide planting and design plans — I am not responsible for site preparation, planting, or installation unless explicitly agreed.
I recommend that qualified contractors are used for any hard landscaping or structural work.

7. Ownership of Design Work

All design concepts, planting plans, and drawings remain the intellectual property of Enchanted Gardens Design until full payment is received.

8. Responsibility for Plant Supply & Establishment

Responsibility for sourcing, planting, and establishment of plants rests with the client or their appointed contractor unless agreed in writing. I am happy to provide names of nurseries/plant suppliers.

9. Plant Quantities & Sourcing

Plant quantities are estimated based on standard industry spacing guidelines and the information available at the time of design. While every effort is made to ensure accurate quantities, slight over- or underestimation may occur due to supplier availability, plant sizes, or site conditions. I recommend clients confirm final quantities with their supplier or contractor before ordering. I’m always happy to assist with checking or adjusting lists if needed.

10. Changes After Completion

I am not responsible for any alterations to the design made by others after the completion of my work.

11. Responsibility for Contractor Changes

I am not responsible for any changes, adjustments, or substitutions made by contractors, landscapers, or third parties after the delivery of the final design. Any alterations carried out without my written agreement fall outside the scope of my design liability.

12. Photography & Portfolio

With your permission, I may photograph completed projects for my portfolio and promotional use. Any images will be used respectfully and without disclosing personal details.

13. Cancellation Policy

If the project is cancelled by the client after work has commenced, fees will be payable for work completed up to that point, with a minimum of 50% of the quoted fee.

14. Compliance with Building Regulations and Best Practice

I believe the best results come from working together. I bring professional expertise, horticultural knowledge, and site experience to every project — and I value your input throughout the process.

Where I feel a requested element might not suit the site, growing conditions, or design integrity, I’ll always explain my reasoning and suggest suitable alternatives. My goal is to create a design that’s both beautiful and practical for your garden, and I appreciate your trust in my professional judgement.

15. Professional Advice & Design Integrity

I am committed to designing in line with UK building regulations, health and safety standards, and best horticultural practice. Where I believe that a requested design element or work may contravene regulations, present a safety risk, or be unsuitable for the site, I reserve the right to decline that element of the design.

I will always advise clients of any concerns and suggest suitable alternatives where possible.

16. Review of Plans & Client Responsibility

All plans and drawings are prepared with care and checked before delivery. However, as with any design work, minor human errors may occasionally occur. I kindly ask clients to review their plans upon receipt and let me know of any corrections or concerns within seven (7) days, so I can address them promptly. Once approved, the plans are considered final.

17. Force Majeure — Events Beyond My Control

I will always aim to meet agreed deadlines, but I cannot be held responsible for delays caused by circumstances beyond my control — such as extreme weather, illness, supply chain disruptions, or other unforeseen events. Should any such delays occur, I will communicate openly and work with you to agree on a revised timeline.

18. Confidentiality & Use of Information

I respect your privacy and treat all client information as confidential. I will not share personal details, project information, or images of your garden without your consent.

Likewise, I ask that clients respect my creative work and do not share or reproduce my designs, plans, or materials without permission.

19. Governing Law

These terms are governed by the laws of England and Wales.
